This contract and the terms and conditions attached hereto set forth the terms and conditions under which the Company will provide the services, including any future services, provided to you. The person or persons to whom or for who service is provided, their heirs, executors, administrators, successors and assigns, as applicable, are referred to herein as “the Client”. The employee, agent, contractor, sub-contractor or other person selected by the Company to provide service to the Client is referred to herein as the “Sitter”. The location at which service is provided is referred to herein as the “Premises”. RESERVATION AND PAYMENT FOR SERVICE All payments to the Company may be made by any credit card accepted by the Company, cheque or by e-transfer. If reservation of a particular service requires advance payment of any amount, the Company will only assign a Sitter to provide the reserved service if such payment is rendered at the time service is reserved. Otherwise, the Company will consider the service to be non-confirmed and will not assign a Sitter until payment is received. Full payment by cheque or e-transfer is required prior to first day of service. Payment by credit card on file is charged on last day of service. CANCELLATION OR CHANGE OF SERVICE There is no charge for cancellations made with more than a 24 hour notice (except for key return and non-refundable deposit for new customers as described below). Any cancellation with less than 24 hour notice will be charged a fee. NSF POLICY Should a cheque payment not clear, the Company may, without prior notice or authorization, and without the cardholder’s signature, charge the amount of the cheque which did not clear, plus any administrative fee against any credit card on file with the Company. Additional fees will be charged on all NSF cheques. OUR SERVICES All new customer bookings require a 50% non-refundable deposit at the time service is reserved. The remaining 50%, plus any and all taxes are due and payable on the last day of scheduled service and if not received by this date, the Company may apply the charge without the cardholder’s signature, against any credit card on file with the Company. In addition to the service fee, some services (i.e. live-in services but not limited to) may include a further charge. In the case of a live-in Sitter, the Client is required to make suitable arrangements with their Sitter to provide food and/or a cash food allowance during the period of service. Note that the length of live-in assignments is based on the number of calendar days (with a minimum of 2 days), not 24-hour periods, of service. There is no charge for an initial consultation and key pickup. There may be a fee to return keys. We encourage keys to be left with your sitter between bookings. GENERAL In consideration for the Company and the Sitter providing services, the Client for itself and on behalf of all other occupants or residents of the Premises, hereby release, waive and discharge the Company and its directors, officers, employees and agents, including the Sitter (collectively, the “Releasees”), from any and all liabilities, claims, including for the Releasees’ negligence, judgments, losses, costs, expenses, damages, including damages to the Premises, or injuries, including death or sickness, to persons or to animals, that may be sustained as a result of, or in connection with the Releasees providing the services. Further, the Releasees are not liable for any loss, damage or injury caused directly or indirectly by any animal or person residing in or visiting the Premises under the care of the Releasees, however caused, including but not limited to the soiling or damage of carpets or furniture by pets, or any damage to the Premises by any person who visited or resided in the Premises at any time during the period over which the Releasees provided the services. The Client hereby warrants that it has read and explained this waiver of liability statement to all other occupants or residents of the Premises, and any other owners of the pets, and that all such persons fully understand its entire content, and acknowledge such release and discharge of the Releasees. The Client hereby indemnifies and saves harmless the Releasees against any and all liabilities, claims, losses, costs (including fees on a solicitor and client basis) damage or injury to the Premises, contents, animals, occupants or visitors which may occur during the provision of services by the Releasees. It is agreed and understood by the Company and the Client that the Company is not an insurer and that insurance, if any, covering personal injury and property loss or damage at the Premises shall be obtained by the Client. The Company is being paid to provide agreed upon services. The amounts being charged by the Company are not sufficient to compensate the Client for loss or damage, and the Company is not assuming responsibility for any such loss or damage which may occur by reason of failure or deficiency in service in any respect, even if due to the Releasees’ negligent performance or failure to perform. If there is any damage to the Premises as a result of the Sitter providing the services, the Client undertakes to inform the Company of such damage as soon as possible, but in any event no later than 7 days after the services were provided. The Company cannot guarantee the availability of a particular Sitter to provide the service and reserves the right to change such Sitter at its discretion and under certain circumstances, including but not limited to when such Sitter becomes unavailable due to illness, accident, injury or other reason. The Client hereby authorizes the Company and /or the Sitter to act as its agent to take such steps as the Company and /or Sitter deems necessary to ensure the safety and security of the Premises, animals or persons in the Company’s care and the Client agrees to be financially responsible for any steps whose cost is not a part of the service fee, including but not limited to an extension of service, additional visits, veterinary care, HVAC, electrical or plumbing work. The Client agrees that they will not at any time solicit, accept, suggest or otherwise encourage private employment or contracting of any Sitter of the Company. No addition or alteration of this contract shall be considered binding unless same is initialed by the Company and the Client. This will confirm that you are consenting to the provision of any personal information that may be requested and required by the Company to permit us to provide our services to you, and further that you are consenting to the Company’s continued storage of any such personal information for a reasonable period of time, under secure conditions, as may be required to allow us to continue to provide our services to you.
